台中市民李姓夫婦兩年前帶著就讀國小的兒子，前往廣三崇光百貨公司漢來餐廳用餐後，自餐廳旁手扶梯離開時，因該處積有大片水漬，致李童踩踏水漬後重心不穩滑倒，頭部著地受有輕度腦震盪，經李姓夫婦提告，台中地檢署今天依過失傷害罪起訴樓管員陳女、及漢來餐廳負責人鄒男。鄒男（47歲）辯稱，水漬並非漢來餐廳流出，且發生水漬的地點，屬公共區域域，並非漢來餐廳所負責，但法官查出陳女（45歲）對清潔工作負有監督之責、鄒男為案發現場的分層負責管理人，縱廣三崇光百貨已經將清潔工作委由其他公司負責，兩人無法免除場所管理人注意義務。法官強調，百貨公司提供服務予消費大眾，法律關係即存在於百貨與消費者間，而百貨與清潔公司承攬契約屬內部的法律關係，果百貨無庸負其監督、管理之責，試問至百貨消費大眾有何權益保障？
